1. Penerimaan Terma

Selamat datang ke MyKhairat. Dengan mengakses atau menggunakan platform kami, anda bersetuju untuk terikat dengan Terma Perkhidmatan ini ("Terma"). Jika anda tidak bersetuju dengan Terma ini, sila jangan gunakan perkhidmatan kami.

These Terms constitute a legally binding agreement between you (whether individually or on behalf of an entity) and MyKhairat regarding your use of the MyKhairat SaaS platform.

2. Definisi

• "Platform" refers to the MyKhairat SaaS platform, including all websites, applications, and services
• "Services" refers to all features and functionality provided by MyKhairat
• "User," "You," "Your" refers to the individual or organization using the Platform
• "Tenant" refers to a registered mosque, masjid, surau, or mussolla organization
• "Member" refers to individuals registered in a Tenant's khairat system
• "Administrator" refers to users with administrative access to a Tenant account

3. Pendaftaran Akaun

3.1 Kelayakan

To use our Platform, you must:

• Be at least 18 years of age
• Represent a legitimate mosque, masjid, surau, or mussolla organization
• Have the authority to bind the organization to these Terms
• Provide accurate and complete registration information

3.2 Keselamatan Akaun

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring that all users under your account comply with these Terms

3.3 Pengesahan Akaun

All new accounts are subject to verification and approval by MyKhairat. We reserve the right to reject any application or suspend any account at our discretion.

4. Langganan dan Pembayaran

4.1 Pelan Langganan

MyKhairat offers various subscription plans (Starter, Professional, Enterprise) with different features and pricing. Details are available on our pricing page.

4.2 Percubaan Percuma

New users may be eligible for a free trial period (typically 30 days). No payment is required during the trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless cancelled.

4.3 Terma Pembayaran

• Subscription fees are billed monthly or annually in advance
• Payment must be made via the methods specified on the Platform
• All fees are in Malaysian Ringgit (MYR) and exclusive of applicable taxes
• Failed payments may result in service suspension

4.4 Perubahan Harga

We reserve the right to change our pricing with 30 days' written notice. Price changes will not affect your current billing cycle.

4.5 Polisi Bayaran Balik

• Subscription fees are non-refundable except as required by law
• If you cancel your subscription, you will retain access until the end of your paid period
• No refunds for partial months or unused features

5. Polisi Penggunaan Yang Diterima

5.1 Penggunaan Yang Dibenarkan

You may use the Platform for:

• Managing khairat member information and contributions
• Processing payments and financial transactions
• Managing claims and disbursements
• Generating reports and analytics
• Communicating with members

5.2 Aktiviti Yang Dilarang

You must not:

• Use the Platform for any illegal or unauthorized purpose
• Violate any laws, including data protection and privacy laws
• Upload or transmit viruses or malicious code
• Attempt to gain unauthorized access to any part of the Platform
• Interfere with or disrupt the integrity or performance of the Platform
• Collect or harvest information about other users
• Use the Platform to send spam or unsolicited communications
• Resell, sublicense, or redistribute the Platform without authorization
• Reverse engineer, decompile, or disassemble any part of the Platform
• Remove or modify any proprietary notices or labels

6. Perlindungan Data dan Privasi

6.1 Data Anda

You retain all rights to the data you input into the Platform. By using our services, you grant us a license to process your data solely for the purpose of providing and improving our services.

6.2 Dasar Privasi

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

6.3 Keselamatan Data

We implement reasonable security measures to protect your data. However, no system is completely secure, and we cannot guarantee absolute security.

6.4 Sandaran Data

We perform regular automated backups of your data. However, you are responsible for maintaining your own backup copies of important data.

7. Hak Harta Intelek

7.1 Harta Kami

The Platform, including all content, features, functionality, software, source code, and design, is owned by MyKhairat and protected by intellectual property laws.

7.2 Pemberian Lesen

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Platform for your internal business purposes.

7.3 Tanda Dagangan

"MyKhairat" and associated logos are trademarks of MyKhairat. You may not use these without our prior written permission.

8. Ketersediaan dan Pengubahsuaian Perkhidmatan

8.1 Ketersediaan Perkhidmatan

We strive to provide 99.9% uptime but cannot guarantee uninterrupted access. The Platform may be temporarily unavailable due to:

• Scheduled maintenance
• Emergency repairs
• Technical issues beyond our control
• Force majeure events

8.2 Pengubahsuaian Perkhidmatan

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time. We will provide reasonable notice of material changes.

9. Perkhidmatan Pihak Ketiga

9.1 Gerbang Pembayaran

We integrate with third-party payment gateways (FPX, iPay88, etc.). Your use of these services is subject to their respective terms and conditions.

9.2 Perkhidmatan SMS dan E-mel

We use third-party providers for SMS and email notifications. Delivery of messages is subject to the terms and reliability of these providers.

9.3 Tiada Liabiliti Untuk Pihak Ketiga

We are not responsible for the actions, products, or services of third-party providers.

10. Had Liabiliti

10.1 Tiada Kerosakan Tidak Langsung

To the maximum extent permitted by law, MyKhairat shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

10.2 Had Liabiliti

Our total liability for all claims arising from your use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim.

10.3 Pengecualian

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

11. Indemnifikasi

You agree to indemnify and hold harmless MyKhairat and its affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws

12. Penamatan

12.1 Penamatan Oleh Anda

You may cancel your subscription at any time through your account settings. Your access will continue until the end of your current billing period.

12.2 Penamatan Oleh Kami

We may suspend or terminate your account if:

• You breach these Terms
• Your payment fails
• We are required to do so by law
• We decide to discontinue the Platform

12.3 Kesan Penamatan

Upon termination:

• Your right to access the Platform immediately ceases
• You must pay any outstanding fees
• We may delete your data after a reasonable period (typically 30 days)
• You may request a data export before deletion

13. Penafian

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties regarding accuracy, reliability, or availability
• Warranties that the Platform will be error-free or uninterrupted

14. Penyelesaian Pertikaian

14.1 Undang-undang Yang Mengawal

These Terms shall be governed by and construed in accordance with the laws of Malaysia.

14.2 Bidang Kuasa

Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Malaysia.

14.3 Penyelesaian Tidak Formal

Before filing any formal legal action, you agree to attempt to resolve disputes informally by contacting us at support@mykhairat.my.

15. Peruntukan Am

15.1 Keseluruhan Perjanjian

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyKhairat regarding the Platform.

15.2 Kebolehasingan

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Penepian

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Penyerahan Hak

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

15.5 Perubahan Terma

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or platform notification. Your continued use after changes constitutes acceptance of the modified Terms.
